LOL. sure thing Tom’s lawyer.

Good to see Tom paid the costs and did not owe for the water.

He didn’t pay for the costs in full and did owe, the article makes that clear.

It’s unfortunate no one including myself thought to note that cities do sell water to construction companies vie permits and fees.

It doesn’t matter if the construction company had rights within the district. State law prohibits the private transportation of such water across district lines.

The law “was violated each and every time a delivery of Calleguas-supplied water was made outside legal boundaries,” she said.

Mulligan further clarified that the water’s cost reflects a wider series of payments. Those who live outside the water district have not contributed taxes and other fees toward the maintenance of the water district’s infrastructure, she said.

The water delivered and used in this case was not fully paid for, period,” Mulligan said.

Also not in the article is the fact that Selleck should have been very aware of this because there was a previous agreement to allow Hidden Valley residents to truck in water during the drought in 2009. That drought relief program was shut down after just a few months when the water district manager became aware of the state law in question and the reasoning behind it.

In 2009, when the state was mired in its final year of a previous drought, Selleck and about five others gained permission to fill up trucks from a water hydrant in nearby Lake Sherwood, said Reddy Pakala, then the director of water and sanitation for the Ventura County Public Works Agency.

That special agreement lasted a few months. Pakala said it was canceled after he learned about a law that bans transferring potable water outside a district’s boundaries.

Selleck has no plausible deniability in this case. He knew he could no longer get permission so he chose to have the water delivered against State law.

Made it clear there was a very technical violation. Not a theft of water as previously described. Complete 100% innocence was not asserted nor required here.

All that district transfer stuff sounds to me like a local official who thought he had a celebrity thief caught red handed has now got to scramble to justify the costs given the paltry result. Reminds me of a guy that pays retail but cheats on the user/sales tax. Pays his counties lower rate instead of the higher local tax.

Drought shame? Hardly. This is clearly another failed gotcha moment . Overblown by far in the original article.

Aquifers don’t care where we draw district lines on the surface. Tax officials do.

Selleck has always seemed like a good guy — conservative, but not right wing whacko. There are many in the NRA like that —we can just hope they realize with whom they are associating —like Bush I.

I agree, this is a failed gotcha moment.
